Waar deze verordening niet voorziet in een harmonisering van de administratieve straffen of indien nodig in andere gevallen, bijvoorbeeld bij ernstige inbreuken op deze verordening, dienen de lidstaten een systeem toe te passen dat zorgt voor doeltreffende, evenredige en afschrikkende straffen. De aard van die straffen, strafrechtelijk of administratief, dient te worden bepaald in het lidstatelijke recht.
