Wanneer uit hoofde van het internationale publiekrecht het lidstatelijke recht van toepassing is, dient deze verordening ook van toepassing te zijn op een verwerkingsverantwoordelijke die niet in de Unie is gevestigd, maar bijvoorbeeld bij een diplomatieke vertegenwoordiging of een consulaire post actief is.
