Wanneer deze richtlijn niet voorziet in de harmonisatie van administratieve sancties of indien nodig in andere gevallen, bijvoorbeeld bij een ernstige inbreuk op deze richtlijn, moeten de lidstaten een systeem toepassen dat voorziet in doeltreffende, evenredige en afschrikkende sancties. De aard van die sancties en of zij strafrechtelijk of administratief zijn, moet worden bepaald door het nationale recht.
