According to Article 46(1) of Regulation (EU) 2016/679 (hereinafter “ GDPR ”), any transfer to controllers and/or processors in third countries not covered by a European Commission adequacy decision could be carried out if the controller or processor has provided appropriate safeguards, and on condition that enforceable data subj ect rights and effective legal remedies for data subjects are available.
