This article examines Article 22 of the GDPR and its aim to enhance data subjects’ control over decisions based solely on automated processing. Whilst this goal is difficult to achieve in light of the characteristics of automated systems, it is nonetheless possible to interpret Article 22 in ways that would enhance protection afforded to data subjects who cannot successfully exercise control over automated decision-making.
