Article 2 of Law No 506/2004 provides, in paragraphs 1 and 2 thereof: ‘1. For the purpose of this Law, the following terms shall bear the following meanings: … (d) communication – any information exchanged or transmitted between a specified number of participants by means of a publicly available electronic communications service; this does not include information transmitted to the public over an electronic communications network as part of an audiovisual programme service to the extent that the information concerned cannot be related to the identifiable subscriber or user receiving the information; … 2 The definitions set out … in Article 1(1) and (8) of Legea nr. 365/2002 privind comerțul electronic [(Law No 365/2002 on electronic commerce) of 7 June 2002 (republished in Monitorul Oficial al României, Part I, No 959 of 29 November 2006)] … shall also apply to this Law.’
