On 26 September 2019, the ANSPDCP drew up an infringement report, by which it imposed on Inteligo Media a fine of RON 42714 (approximately EUR 9000) for infringement of Article 5(1)(a) and (b), Article 6(1)(a) and Article 7 of the GDPR. The ANSPDCP took the view that that company had not been able to prove that it had obtained express consent from 4357 users to the processing of their personal data (email address, password, username) and that it had processed those data in a manner incompatible with the purpose for which they had initially been collected. Those data, initially collected for the purpose of performing the contract at issue, had been processed for the purpose of transmitting the ‘Personal Update’ newsletter.
