In the first place, the applicant submits that the information referred to in Article 39(2)(b) and (c) of Regulation 2022/2065, namely the information relating to the natural person on whose behalf the advertisement is presented and the information relating to the natural person who paid for the advertisement if different from the person on whose behalf the advertisement is presented, constitutes personal data and therefore claims that that provision is contrary to Articles 7 and 8 of the Charter of Fundamental Rights of the European Union (‘the Charter’).
