That finding cannot be called into question by the applicant’s argument that the objectives of Article 39 of Regulation 2022/2065 can be attained in an equally effective manner by other means less prejudicial to its fundamental rights by means of Article 40(8) of that regulation, which protects confidential information by not making the information and data listed in Article 39(2) of that regulation available to the general public, in particular to competitors.
