RECHTBANK AMSTERDAM INTERNATIONALE RECHTSHULPKAMER Parketnummer: 13-120273-26 (EAB I) Datum uitspraak: 10 september 2026 UITSPRAAK op de vordering van 17 juli 2026 van de officier van justitie bij deze rechtbank tot het in behandeling nemen van een Europees aanhoudingsbevel (EAB). Dit EAB is uitgevaardigd op 16 april 2026 door the Prosecutor General’s Office of the Republic of Latvia , Letland (hierna: de uitvaardigende justitiële autoriteit) en strekt tot de aanhouding en overlevering van: [opgeëiste persoon] , geboren op [geboortedag] 2003 in [geboorteplaats] (Letland)), zonder vaste woon- of verblijfplaats in Nederland, gedetineerd in [detentieplaats] , hierna ‘de opgeëiste persoon’. 1 Procesgang De behandeling van het EAB heeft plaatsgevonden op de zitting van 27 augustus 2026, in aanwezigheid van mr. E.M. Meppelink, officier van justitie. De opgeëiste persoon is verschenen en is bijgestaan door mr. M. de Klerk, advocaat in Haarlem, en door een tolk in de Russische taal. De rechtbank heeft de termijn waarbinnen zij op grond van de Overleveringswet (OLW) uitspraak moet doen over de verzochte overlevering met 30 dagen verlengd. Ook heeft de rechtbank voor sluiting van het onderzoek ter zitting de gevangenhouding bevolen. 2 Identiteit van de opgeëiste persoon Ter zitting heeft de opgeëiste persoon verklaard dat de bovenvermelde persoonsgegevens juist zijn en dat hij de Letse nationaliteit heeft. 3 Grondslag en inhoud van het EAB Het EAB vermeldt een vonnis, namelijk een judgment of the Riga City Court van 21 januari 2025, met referentie 19730342724. De overlevering wordt verzocht voor de tenuitvoerlegging van een vrijheidsstraf voor de duur van vijf jaren. De opgeëiste persoon is tot deze straf veroordeeld in het hiervoor genoemde vonnis. De hiervoor genoemde veroordeling ziet op het feit zoals dat is omschreven in het EAB. 4 Weigeringsgrond als bedoeld in artikel 12 OLW Het EAB vermeldt dat de opgeëiste persoon in persoon is verschenen bij het proces dat tot de beslissing heeft geleid. De weigeringsgrond van artikel 12 OLW is daarom niet van toepassing. 5 Strafbaarheid Feit waarvoor dubbele strafbaarheid is vereist De uitvaardigende justitiële autoriteit heeft het strafbare feit niet aangeduid als lijstfeit. Overlevering kan in dat geval worden toegestaan, als – kort gezegd – voldaan is aan de vereisten dat voor het feit een vrijheidsstraf van ten minste vier maanden is opgelegd aan de opgeëiste persoon en het feit ook naar Nederlands recht strafbaar is. De rechtbank stelt vast dat hieraan is voldaan. Het feit levert naar Nederlands recht op: opzettelijk handelen in strijd met een in artikel 2 onder C, van de Opiumwet gegeven verbod, meermalen gepleegd. 6 Artikel 11 OLW: detentieomstandigheden Inleiding In andere zaken die zagen op Letse EAB’s heeft de rechtbank geoordeeld, onder meer in haar uitspraken van 21 februari 2024 en 19 september 2024 , dat sprake is van een algemeen reëel gevaar dat gedetineerden in Letland aan een onmenselijke of vernederende behandeling zullen worden blootgesteld. Het algemeen gevaar ziet met name op het bestaan van een informele hiërarchie onder gedetineerden (het ‘kastenstelsel’) in de Letse gevangenissen, met geweld tegen, en een vernederende behandeling van, gedetineerden in de lagere kasten als gevolg. The European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (hierna: CPT) heeft op 26 februari 2025 een wederom zeer kritisch rapport uitgebracht over Letland naar aanleiding van het bezoek dat van 24 tot 31 mei 2024 heeft plaatsgevonden. Zoals de rechtbank eerder heeft geoordeeld geeft dit rapport geen aanleiding om anders te oordelen over het eerder vastgestelde reële gevaar van schending van artikel 4 Handvest van de grondrechten van de Europese Unie (hierna: Handvest) voor gedetineerden in Letland. De Letse autoriteiten ( The Department of Imprisonment Institutions ) hebben bij brief van 15 juli 2026 onder meer het volgende geantwoord op de door het Internationaal Rechtshulp Centrum (IRC) gestelde vragen: " (...) The Administration would like to inform that in case of [opgeëiste persoon] 's extradition to the Republic of Latvia, [naam] will initially be placed in the Remand (Investigation) Prison Section of the Liepāja Prison. His placement will then be determined in accordance with the criteria set forth in the regulatory enactments specified below in this letter, as well as taking into account the location of the person directing the proceedings. (...) The new Liepäja Prison was opened in 2026 as planned and it increased the capacity of places of imprisonnent. The newly built [onleesbaar] Liepäja Prison ensures that sentences are served as effectively as possible and in a manner that safeguards public safety; in particular, the specially planned, designed, and implemented infrastructure allows for the supervision of imprisoned persons to be carried out with fewer staff resources. In Liepäja Prison, the imprisoned persons are placed in individual cells rather than dormitory-style rooms. The advantages of new technologies provide a significant in the areas of supervision, security and safety, thereby allowing the staff to focus much more on rehabilitation and safety measures, reducing the commission of new criminal offenses, and onwards in daily operations placing greater emphasis on putting effort to change the behaviour of an imprisoned person and to eliminate informal hierarchies. The administration, officials and employees of the places of imprisonment in the Republic of Latvia (including the Liepäja Prison) comply with both national and international laws and regulations. The staff of the places of imprisonment in the Republic of Latvia (including the Liepäja Prison) treat the prisoners humanely and do not subject them to any ether difficulties or restrictions other than those arising from the purpose of imprisonment and the necessary and inevitable consequences of imprisonment. In particular, when executing any type of criminal sentence, including also a restraint measure - arrest, certain guarantees are provided in the places of imprisonment in the Republic of Latvia against torture and inhuman or degrading treatment of imprisoned persons. (…) The Administration would like to indicate that it is not possible to provide every imprisoned person with a single-occupancy cell, but in the event of a threat, the relevant person is immediately transferred to a single-occupancy cell, small-capacity cell, or to another cell; however, if the threat is very serious, the relevant person may also be transferred to another prison. (…) In places of imprisonment (including the Liepäja Prison), each event is examined individually in order to select the most appropriate and effective measures to protect the relevant prisoner, taking into account the following: severity and sources of the threat, the need for security for the prisoner, possible conflict situations in the place of imprisonment, and CPT recommendations. All places of imprisonment (including the Liepäja Prison) are equipped with video surveillance cameras and it helps officials to immediately react to threats, suspicious or violent behaviour, and to prevent physical and emotional violence among imprisoned persons, especially in areas where a larger number of prisoners may be held, also if they are from different cells. Given that the use of video surveillance cameras in places of imprisonment reduces the possibility of influencing prisoners from 'lower caste', it also contributes to reducing the prevalence of informal hierarchies among imprisoned persons. Technical means are also used to prevent unauthorized objects from being brought into places of imprisonment, which also reduces the influence of the informal hierarchy among prisoners. The Administration also informs that imprisoned persons' safety is assured by carrying out regular inspections and supervision. The prison staff are trained in conflict solving and violence prevention. Every official, while performing his / her official duties, is responsible for responding immediately to any prisoner's complaint or request for assistance in order to ensure the imprisoned person 's safety and prevent potential risks to this person's health or life. (…) At the same time, it should be noted that the management of the Administration on a regular basis monitors prison conditions and ensures their compliance with international standards, including the guidelines of the European Committee for the Prevention of Torture and lnhuman or Degrading Treatment or Punishment (hereinafter referred to as the CPT). (…) Taking into consideration the aforementioned, in the places of imprisonment in the Republic of Latvia (including the Liepäja Prison) it is ensured that prisoners are not subjected to inhuman or degrading treatment and that all relevant guarantees arising from national and international regulatory enactments are observed. (…) Thus, in places of imprisonment in the Republic of Latvia (including the Liepäja Prison), there is ensured targeted and effective protection for prisoners, based on individual risk assessment and applying the most appropriate security measures. The Administration would like to inform that uninterrupted day and night (24-hour) monitoring system in places of imprisonment provides active and preventive protection for the imprisoned persons, including situations when a prisoner is at risk of violence or inhuman treatment due to the informal hierarchy. A system of uninterrupted 24-hour monitoring includes - video surveillance and regular inspections carried out by the staff. It should be noted that video surveillance cameras allow for the prompt identification of any suspicious or aggressive situations. Video surveillance cameras are placed in common areas, transit areas, and other critical locations, ensuring constant monitoring of the situation. (…) In addition to the aforementioned, officials are available for uninterrupted communication with imprisoned persons during day and night. The cells that are imprisoned persons' living space are equipped with intercom systems, which provide prisoners with unlimited access to communicate with the specific official assigned to the respective post. At the same time, officials also have the technical capability to remotely communicate with any cell from their post using the intercom system installed there, and, if necessary, to speak with a prisoner at any time of day, including in urgent or crisis situations. In summary, the uninterrupted 24-hour (that is - 24/7) monitoring system combines video surveillance, regular inspections by staff and prompt actions to effectively prevent violence and to ensure the protection of prisoners from inhuman or degrading treatment. (…) At the new Liepäja Prison, the cells that are imprisoned persons' living space have been designed in accordance with modem security and human rights standards, and one of the most significant technological features is the intercom system installed in these cells. This system significantly changes daily communication between imprisoned persons and prison staff. The intercom system in each cell allows prisoners to contact an officer on duty at the relevant post at any time. This means that inmates do not have to wait for staff patrols or cell checks to report a problem or ask for help. Communication takes place via a direct audio channel between the cell and the monitoring post. (…) The new Liepäja Prison has a modern X-ray baggage screening system installed therein, which significantly enhances security controls at this specific place of imprisonment. This technology allows for detailed inspection of various items entering the prison premises to detect prohibited substances, objects, or specially designed hiding places in a timely manner. With the help of the X-ray system, it is possible to inspect items brought to inmates, parcels received by mail, personal belongings, and household items.” Op aanvullende vragen van het IRC hebben de Letse autoriteiten op 24 juli 2026, voor zover relevant, de vragen als volgt beantwoord: “The Prison Administration is taking a number of measures to protect prisoners from violence, intimidation, humiliation and other negative manifestations of the informal "caste system". The administration has a duty to ensure a safe environment, respect human rights and prevent any exposure of prisoners to the influence or violence of others. For this purpose, monitoring of prisoners shall be ensured, security risks shall be assessed, persons who are conflicting or endangered persons shall be separated, if needed, as well as there shall be an operational response to information regarding violence, threats or degrading treatment. Prisoners shall have the opportunity to submit complaints and report violations to the administration, the Prison Administration, the Ombudsman or other competent authorities, while the administration shall have the duty to verify such information and to take the necessary security measures. In addition, social rehabilitation, behavioural adjustment and psychological support measures are organised in prisons, which promote mutual respect and reduce the risks of violence among prisoners.” Op 12 augustus 2026 hebben de Letse autoriteiten, voor zover relevant, het volgende medegedeeld op de vraag van het IRC om een zeer specifieke garantie voor de opgeëiste persoon: “(…) The Administration hereby informs that in case of extradition to the Republic of Latvia, the person referred above will be initially placed in the Remand Prison Unit in Liepäja Prison. As regards the specific places of imprisonment where [opgeëiste persoon] will be placed, the Administration hereby notes that, if a security measure applied to [opgeëiste persoon] - arrest - is extended, [opgeëiste persoon] will continue to be placed in the Remand Prison Unit in Liepäja Prison. Currently, it is not possible to determine in which prison [opgeëiste persoon] would be serving his sentence of imprisonment, if he were convicted. Please note that convicted persons are sent to specific places where the sentence is to be served, taking into account the length of time for which the sentence imposed must be served, the severity and nature of the offence committed, the convicted person's health, psychological characteristics, and, where possible, the convicted person's age, ability to work, the speciality held, as well as the place of permanent residence of the convicted person. (...) In Liepäja Prison, prisoners are held in small cells for 2 persons. The Liepäja Prison does not have bigger cells than for 2 persons. In the cell for 2 persons, one prisoner may be allocated, if needed, and such cells are usually used for the prisoners who need enhanced supervision or who, due to their personality, the nature of crime and their behaviour, cannot be placed together with other prisoner. Please be advised that one prisoner is guaranteed a minimum residential area of 5m2 (excluding sanitary facilities) in Liepäja Prison.(...) To control violence among inmates and as far as possible, leaders of non-formal prison hierarchies, their accomplices and other prisoners who have a negative influence on others are held separately from other vulnerable inmates. Leaders of non-formal prison hierarchies are isolated on separate floors and in separate locked cells. In all Latvian prisons, prisoners are subject to assessment on the basis of their potential for violence or the risk of violence to which they may be exposed and, depending on the risks identified, prisoners are differentiated and placed in cells in such a way that ensures their safety. Prison staff continuously monitor the microclimate among inmates and apply preventive measures to avoid violent conflicts if they identify or receive information about any potential risk of violent conflicts among inmates, including separating those who may have a violent conflict, redistributing prisoners in cells or isolating them.(…) [opgeëiste persoon] will be placed in a cell with other prisoners only after it is established that there is no risk of conflict among these inmates and they are capable of coexisting peacefully in one cell. It should be noted that activities in prisons are organised in accordance with a pre-arranged daily routine activity plan, which eliminates any possibility for the prisoners with a potential risk of conflict to meet in common-use areas and/or activities. The safety of [opgeëiste persoon] in prison outside the cell, i.e. in the common-use areas, in the yard, will be ensured as follows: by officers working in assigned posts and monitoring the microclimate among prisoners, and thereby identifying, in a timely manner, any possible preconditions for violent conflicts and taking measures to prevent conflicts before they start; by monitoring the situation through video cameras installed in the majority of common-use areas of the prison; by direct communication between the contact officer and [opgeëiste persoon] and by providing him with the necessary assistance .” Het standpunt van de raadsman De verdediging heeft geen beroep gedaan op artikel 11 OLW, omdat de opgeëiste persoon aan Letland wil worden overgeleverd. Het standpunt van de officier van justitie De officier van justitie heeft zich op het standpunt gesteld dat artikel 11 OLW niet aan overlevering in de weg staat, omdat het gevaar op een vernederende en onmenselijke behandeling met de verstrekte detentiegarantie van 12 augustus 2026 voor de opgeëiste persoon is weggenomen. De verstrekte detentiegarantie is – anders dan eerdere garanties in andere Letse overleveringszaken – toegespitst op de opgeëiste persoon. Bovendien bevat de detentiegarantie nieuwe informatie over de Liepāja Prison, de nieuwe detentie-instelling met verschillende (technologische) voorzieningen gericht op het wegnemen van het algemeen gevaar. Het oordeel van de rechtbank De rechtbank stelt vast dat de verstrekte informatie in andere Letse overleveringszaken waarmee het vastgestelde algemeen gevaar moest worden weggenomen, steeds van algemene aard was en niet of nauwelijks zag op de concrete situatie van de opgeëiste persoon. De rechtbank stelt verder vast dat in onderhavige zaak de verstrekte informatie van 12 augustus 2026 nieuwe informatie bevat en specifiek is toegesneden op de opgeëiste persoon. De rechtbank is, gelet op de garantie van de Letse autoriteiten, van oordeel dat het vastgestelde algemene reële gevaar van onmenselijke of vernederende detentieomstandigheden voor de opgeëiste persoon is weggenomen. Het algemene gevaar dat de rechtbank heeft aangenomen, wordt door deze garantie namelijk uitgesloten ten aanzien van de opgeëiste persoon. De rechtbank vindt daarbij het volgende van belang. De opgeëiste persoon – van wie de overlevering wordt verzocht zowel wegens onderhavig executie-EAB als een vervolgings-EAB, welk EAB gelijktijdig met onderhavig EAB is behandeld – zal na overlevering naar alle waarschijnlijkheid ten behoeve van zijn vervolging worden geplaatst in the Remand (Investigation) Prison Section of the Liepāja Prison . De rechtbank overweegt dat zij gelet op het arrest ML van het Hof van Justitie van de Europese Unie uitsluitend de detentieomstandigheden dient te onderzoeken in de penitentiaire inrichting(en) waar de opgeëiste persoon, volgens de informatie waarover zij beschikt, naar alle waarschijnlijkheid zal worden gedetineerd, mede op tijdelijke of voorlopige basis . De rechtbank zal daarom ook in onderhavige zaak waarin de overlevering wordt verzocht voor de executie van een aan de opgeëiste persoon opgelegde straf, enkel kijken naar de detentieomstandigheden in the Remand (Investigation) Prison Section of the Liepāja Prison. Gelet op voornoemd ML-arrest hoeft de rechtbank daarnaast niet ook te onderzoeken waar de opgeëiste persoon te zijner tijd de opgelegde (en eventueel nog op te leggen) straf zal ondergaan. De rechtbank stelt op grond van voornoemde aanvullende informatie vast dat the Liepāja Prison een in 2026 geopende nieuwe gevangenis betreft. In the Liepāja Prison worden gedetineerden niet langer gedetineerd in dormitory-style rooms, nu de the Liepāja Prison enkel over cellen beschikt die geschikt zijn voor maximaal twee personen. Daarbij is een persoonlijke leefruimte van 5m2 (exclusief sanitair) gegarandeerd. Bovendien is iedere cel voorzien van een intercom, waarmee op elk moment direct contact met een beveiliger tot stand kan worden gebracht. De opgeëiste persoon zal pas in een cel worden geplaatst met een andere gedetineerde nadat is vastgesteld dat er geen risico is op conflicten, waarbij leiders en gedetineerden met negatieve invloed apart worden gehouden. Ook worden activiteiten georganiseerd middels een ‘ pre-arranged daily routine activity plan’ , wat de mogelijkheid elimineert op ontmoetingen in persoon met een risico op conflicten. De rechtbank stelt daarom vast dat garanties zijn gegeven die de veiligheid van de opgeëiste persoon binnen en buiten de cel waarborgen en de negatieve gevolgen van het kastestelsel ondervangen. Artikel 11 OLW staat daarom niet aan overlevering in de weg. 7 Slotsom De rechtbank stelt vast dat het EAB voldoet aan de eisen van artikel 2 OLW. Verder staan geen weigeringsgronden aan de overlevering in de weg en is geen sprake van een geval waarin aan het EAB geen gevolg mag worden gegeven. De rechtbank staat daarom de overlevering toe. 8 Toepasselijke wetsbepalingen De artikelen 2, 10 Opiumwet, en 2, 5 en 7 OLW. 9 Beslissing STAAT TOE de overlevering van [opgeëiste persoon] aan the Prosecutor General’s Office of the Republic of Latvia , Letland, voor het feit zoals dat is omschreven in onderdeel e) van het EAB. Deze uitspraak is gedaan door mr. E.M. de Bie, voorzitter, mrs. B.M. Vroom-Cramer en M. Westerman, rechters, in tegenwoordigheid van mr. E.A. Harland, griffier, en in het openbaar uitgesproken op de zitting van 10 september 2026. Ingevolge artikel 29, tweede lid, OLW staat tegen deze uitspraak geen gewoon rechtsmiddel open.
