RECHTBANK AMSTERDAM INTERNATIONALE RECHTSHULPKAMER Parketnummer: 13-004248-26 Datum uitspraak: 16 september 2026 UITSPRAAK op de vordering van 17 juli 2026 van de officier van justitie bij deze rechtbank tot het in behandeling nemen van een Europees aanhoudingsbevel (EAB). Dit EAB is uitgevaardigd op 22 december 2025 door de Rechtbank Deva, Roemenië, (hierna: de uitvaardigende justitiële autoriteit) en strekt tot de aanhouding en overlevering van: [de opgeëiste persoon] , geboren op [geboortedag] 1993 te [geboorteplaats] (Roemenië), inschrijvingsadres in de Basisregistratie Personen: [BRP-adres] , hierna ‘de opgeëiste persoon’. 1 Procesgang De behandeling van het EAB heeft plaatsgevonden op de zitting van 2 september 2026, in aanwezigheid van mr. J.I.P. Hofstee, officier van justitie. De opgeëiste persoon is verschenen en is bijgestaan door zijn raadsvrouw, mr. R.H. Lagerweij, advocaat in Hoofddorp, en door een tolk in de Roemeense taal. De rechtbank heeft de termijn waarbinnen zij op grond van de Overleveringswet (OLW) uitspraak moet doen over de verzochte overlevering met 30 dagen verlengd. Ook heeft de rechtbank voor sluiting van het onderzoek ter zitting de gevangenhouding bevolen, met gelijktijdige schorsing van dat bevel tot aan de uitspraak. 2 Identiteit van de opgeëiste persoon Ter zitting heeft de opgeëiste persoon verklaard dat de bovenvermelde persoonsgegevens juist zijn en dat hij de Roemeense nationaliteit heeft. 3. Grondslag en inhoud van het EAB Het EAB vermeldt een strafvonnis nr. 1409 van 10 oktober 2025, gewezen door de Rechtbank Deva in zaak nr. 6718/221/2024, onherroepelijk geworden op 15 december 2025 krachtens strafrechtelijk arrest nr. 823 van 15 december 2025 van het Hof van Beroep Alba Iulia. De overlevering wordt verzocht voor de tenuitvoerlegging van een vrijheidsstraf voor de duur van drie jaar en negen maanden. De opgeëiste persoon is tot deze straf veroordeeld in het hiervoor genoemde arrest. Deze straf resteert volgens het EAB nog volledig. De hiervoor genoemde veroordeling ziet op de feiten zoals die zijn omschreven in het EAB. 4 Weigeringsgrond als bedoeld in artikel 12 OLW Inleiding Het EAB vermeldt in sectie D onder 2 het volgende: “Nee, de persoon was niet persoonlijk aanwezig op het proces dat resulteerde in het vonnis en de betrokkene was op de hoogte van het voorgenomen proces, heeft een zelf gekozen of van overheidswege toegewezen raadsman gemachtigd zijn verdediging op het proces te voeren, en is op het proces ook werkelijk door die raadsman verdedigd en onder 3.4: de beslissing is niet persoonlijk aan de betrokkene betekend, maar: - de beslissing zal hem na overlevering onverwijld persoonlijk worden betekend, en - de betrokkene zal na de betekening van de beslissing uitdrukkelijk worden geïnformeerd over zijn recht op een verzetprocedure of een procedure in hoger beroep, waarbij hij het recht heeft aanwezig te zijn, waarbij de zaak opnieuw ten gronde wordt behandeld en nieuw bewijsmateriaal wordt toegelaten, en die kan leiden tot herziening van de oorspronkelijke beslissing, en - De betrokkene zal in kennis worden gesteld van de termijn waarbinnen hij de heropening van de strafprocedure moet verzoeken; deze termijn bedraagt één maand vanaf de dag waarop de verdachte, via enige officiële kennisgeving, kennis heeft genomen van het feit dat tegen hem een strafprocedure is gevoerd; dan wel dat hij een rechtsmiddel kan instellen.” Op 16 juli 2026 heeft het Internationale Rechtshulp Centrum (IRC) de volgende vragen aan de uitvaardigende justitiële autoriteit gesteld. “1. In section B of the EAW, two criminal judgements are mentioned: (1) The judgement (no. 1409) by the Court of Deva issued on 10-10-2025 in case no. 6718/221/2024, and (2) the judgement in appeal (no. 823) by the Alba Iulia Court of Appeal on 15-12-2025 in case no. 6718/221/2024. Could you please confirm for which of these two judgements section D of the EAW has been filled out? Judgement (no. 86) by the Court of Deva, issued on 15-01-2024 in case no. 4573/221/2023 2. Could you please confirm that by judgement (no. 86) issued on 15-01-2024 by the Court of Deva, Mr. [de opgeëiste persoon] was sentenced to 1 year and 7 months' imprisonment, the execution of which was conditionally suspended, for (1) driving without a valid driver's licence and (2) driving under the influence of alcohol, offences committed on 03-01-2023? 3. Could you fill in and return the model form of section (included as an annex to this email) for this judgement? Please mention the reference number explicitly in the returned section. 4. Could you please confirm that by judgement (no. 1409) issued on 10-10-2025 by the Court of Deva, the suspension of the custodial sentence of 1 year and 7 months imposed by judgment no. 86 on 15-01-2024 was revoked, and that he was also convicted for driving without a valid driver’s license and driving under the influence of alcohol committed on 05-03-2023, 03-04-2023 and 07- 05-2023? 6. If section D of the EAW has not been filled in for this judgement, could you fill in and return the model form of section D (included as an annex to this email) for this judgement? Regarding Section D of European Arrest Warrant No. 8/2025 We confirm that Section D of European Arrest Warrant No. 8/2025 has been completed both with regard to Criminal Judgment No. 1409/10.10.2025, rendered by the Deva City Court in Case No. 6718/221/2024, as well as with regard to Criminal Decision No. 823/15.12.2025, issued by the Alba Iulia Court of Appeal in the same case. The defendant, [de opgeëiste persoon] , was represented throughout the criminal proceedings before the Deva City Court and the Alba Iulia Court of Appeal by his chosen attorney, Daniela BORHINÃ; the power of attorney was filed on page 3 of the case files. Furthermore, the defendant was aware of the proceedings in the criminal case because, through his chosen defense counsel, at the hearing on 13 November 2024, he submitted a notarized statement - found on page 31 of the case file - in which he admitted to and expressed regret for the acts that are the subject of the case and expressed his agreement to perform unpaid community service. The defendant, through his chosen attorney, filed an appeal against Criminal Judgment No. 1409 of 10 October 2025; the power of attorney authorizing representation before the Alba Iulia Court of Appeals was submitted (page 3 of the case file). At the court hearing on 24 November 2025, before the Alba Iulia Court of Appeal, the defendant's chosen attorney appeared. By Criminal Decision No. 823 of 15 December 2025, rendered in Case No. 6718/221/2024, the Alba Iulia Court of Appeal dismissed as unfounded the appeal filed by the defendant against Criminal Judgment No. 1409 of 10 October 2025. 2. Regarding Criminal Judgment No. 86 of 15 January 2024, rendered in Case No. 4573/221/2023: By Criminal Judgment No. 86 of 15 January 2024, handed down by the Deva Municipal Court in Case No. 4573/221/2023, the defendant, [de opgeëiste persoon] , was sentenced to a combined term of 1 year and 7 months in prison, the execution of which was suspended under supervision for a probationary period of 2 years, for committing the following offenses: - driving a vehicle without a driver's license, as provided for in Article 335 paragraph (1) of the Criminal Code; - driving a vehicle under the influence of alcohol or other substances, as provided for in Article 336 paragraph (1) of the Criminal Code, bath offenses having been committed on January 3, 2023. The defendant, through his chosen attorney, filed an appeal against this judgment. By Criminal Decision_No. 297 of 22 April 2024, issued by the Alba Iulia Court of Appeal in Case No. 4573/221 /2023, the defendant's appeal was dismissed as time-barred, and the judgment became final. 3. With regard to the facts that were the subject of Criminal Judgment No. 86 of January 15, 2024, rendered in Case No. 4573/221/2023: As also stated in Section E of European Arrest Warrant No. 8/2025: In fact, on 3 January 2023, at approximately 1:20 a.m., the defendant, [de opgeëiste persoon] , drove a VOLKSWAGEN vehicle, with license plate number [kenteken] , on the public road at Piata Gãrii in the city of Deva, [plaats] , without holding a driver's license for any category of vehicle and with a blood alcohol concentration of over 0.80 g/1 of pure alcohol, specifically 2.15 g/1 of pure alcohol, as determined by the first biological sample collected, and 1.84 g/1 of pure alcohol in the blood in the second sample collected, as shown in toxicological analysis reports Nos. 29 and 30 dated 5 January 2023. These acts satisfy the elements of the offenses set forth in Article 335 paragraph (1) and Article 336 paragraph (1) of the Criminal Code, with the application of Article 38 paragraph (2) of the Criminal Code. By Criminal Judgment No. 86 of 15 January 2024, the defendant Darius Lucian ZIGAR was sentenced to the following penalties: - 1 (one) year in prison for the offense of driving a vehicle without a driver's license, as provided for in Article 335 paragraph (1) of the Criminal Code (offense committed on 3 January 2023); - 1 (one) year and 3 (three) months in prison for the offense of driving a vehicle under the influence of alcohol or other substances, as provided for in Article 336 paragraph (1) of the Criminal Code (offense committed on 3 January 2023). Pursuant to Article 39 paragraph (1) letter (b) of the Criminal Code, the sentences were consolidated, and the most severe sentence of 1 year and 3 months' imprisonment was imposed, to which the mandatory 4-month increase was added, resulting in a final sentence of 1 year and 7 months' imprisonment. 4. Regarding the presence of the individual at the trial in which Criminal Judgment No. 86 of 15 January 2024 was rendered in Case No. 4573/221/2023: The defendant, [de opgeëiste persoon] , was represented throughout the criminal proceedings by his chosen attorney, Daniela BORHINÃ, both before the Deva City Court and in the appeal proceedings resolved by Criminal Decision No. 297 of 22 April 2024, rendered by the Alba Iulia Court of Appeal, in Case No. 4573/221/2023. Furthermore, the defendant was aware of the proceedings in the criminal case, as, through his chosen defense. counsel, he filed a notarized statement with the case file in which he admitted to and expressed regret for the acts at issue in the case and agreed to perform unpaid community service. The defendant, [de opgeëiste persoon] , through his chosen attorney, filed an appeal against Criminal Judgment No. 86 of 15 January 2024, rendered in Case No. 4573/221/2023; the power of attorney authorizing representation before the Alba Iulia Court of Appeal was submitted. 5. Regarding Criminal Judgment No. 1409 of 10 October 2025, handed down by the Deva City Court in Case No. 6718/221/2024: By Criminal Judgment No. 1409 of 10 October 2025, handed down by the Deva City Court in Case No. 6718/221/2024, the court ordered the revocation of the suspension of the supervised execution of the sentence of 1 year and 7 months' imprisonment imposed by Criminal Judgment No. 86 of 15 January 2024 handed down by the Deva City Court in Case No. 4573/221/2023, which became final on 22 April 2024, pursuant to Criminal Decision No. 297 of 22 April 2024 of the Alba Iulia Court of Appeal. In the same judgment, the defendant was convicted of committing, on 5 March 2023, 3 April 2023, and 7 May 2023, the offenses of driving without a license and driving under the influence of alcohol, and was sentenced to the following penalties: -1 (one) year in prison for the offense of driving a vehicle without a driver's license, as provided for and punishable under Article 335 paragraph (1) of the Criminal Code, with the application of Article 5 of the Criminal Code (offense committed on 5 March 2023); - 1 (one) year and 2 (two) months in prison for committing the offense of driving a vehicle under the influence of alcohol or other substances, as provided for and punishable under Article 336 paragraph (1) of the Criminal Code, with the application of Article 5 of the Criminal Code (offense committed on 5 March' 2023); - 1 (one) year in prison for the offense of driving a vehicle without a driver's license, as provided for and punishable under Article 335 paragraph (1) of the Criminal Code, with the application of Article 5 of the Criminal Code (offense committed on 3 April 2023); - 1 (one) year and 2 (two) months in prison for committing the offense of driving a vehicle under the influence of alcohol or other substances, as provided for and punishable under Article 336 paragraph (1) of the Criminal! Code, with the application of Article 5 of the Criminal Code (offense committed on 3 April 2023); - 1 (one) year in prison for the offense of driving a vehicle without a driver's license, as provided for and punishable under Article 335 paragraph (1) of the Criminal Code, with the application of Article 5 of the Criminal Code (offense committed on 7 May (2023); - 1 (one) year and 2 (two) months in prison for committing the offense of driving a vehicle under the influence of alcohol or other substances, as provided for and punishable under Article 336 paragraph (1) of the Criminal Code, with the application of Article 5 of the Criminal Code (offense committed on 7 May 2023). 6 Regarding Section D of European Arrest Warrant No. 8/2025 We confirm that Section D of the European Arrest Warrant has also been completed with regard to Criminal Judgment No. 1409 of 10 October 2025 issued by the Deva City Court in Case No. 6718/221/2024. 7. Regarding the presence of the individual in the proceedings in which Criminal Judgment No. 1409 of 10 October 2025 was rendered by the Deva City Court in Case No. 6718/221/2024: The defendant, [de opgeëiste persoon] , was represented during the trial in the court of first instance by his chosen attorney, Daniela BORHINÃ; the power of attorney is on page 3 of the case file. 8. Regarding Criminal Decision No. 823 of 15 December 2025, issued by the Alba lulia Court of Appeal in Case No. 6718/221/2024: We confirm that Section D of the European Arrest Warrant has also been completed with regard to Criminal Decision No. 823 of 15 December 2025, issued by the Alba Iulia Court of Appeal. 9. Was Mr. [de opgeëiste persoon] explicitly informed of this?” Op 29 juli 2026 is de volgende aanvullende informatie ontvangen. “ I. Criminal Judgment no. 86 by the Court of Deva City, issued on 15 January 2024 in case no. 4573/221/2023: 1. Regarding the Notification of the Convicted Person of the Date and Location of Court Hearings The defendant, [de opgeëiste persoon] , was not personally served with a summons. The summonses for the first court hearing were sent to the address he himself provided during the criminal investigation, namely: town of Cãlan, [adres] , [plaats] . The acknowledgment of receipt of the summons for the court hearing was signed by [naam oma o.p. ] , as a person residing with the recipient. 2 Response to the questions raised in item 2 of the request a. Did the convicted person, [de opgeëiste persoon] , provide his address to the Romanian authorities, and were the summonses sent to that address? Yes. During the criminal investigation, the convicted person, [de opgeëiste persoon] , was questioned:  as a suspect, on 8 March 2023;  as a defendant, on 12 April 2023, appearing in person and represented by his chosen attorney, Ms. Daniela BORHINÁ. During the hearings, he signed the statements he had given and expressly indicated the address in the town of Cãlan, [adres] , [plaats] , as the address for service of process. All summonses issued during the trial were served at this address. A review of the case file reveals that the convicted person did not provide any other address for the service of procedural documents. At the same time, in the notarized affidavit filed with the case file for the hearing scheduled for 1 November 2023, he again provided the same residential address in the town of Cãlan, [adres] , [plaats] . b. Was the convicted person informed of the obligation to report a change of address and of the consequences of failing to comply with this obligation ? Yes. At each hearing (8 March 2023, and 12 April 2023), the convicted person was informed of the requirement to report any change of address in writing within 3 days. At the same time, he was informed that, in the event of failure to comply with this obligation, the summonses and any other notices sent to the first address remain valid and are deemed to have been received by him. These mentions were recorded in minutes signed by the convicted person (dated 8 March 2023, and 12 April 2023). c. Did these instructions apply to the entire criminal proceeding, and was the convicted person expressly informed of this fact? The instructions provided to the convicted person regarding the obligation to report any change of address and the consequences of failing to comply with this obligation applied to the entire criminal proceeding, as evidenced by the minutes drawn up and signed during the hearings at which the provisions of Article 108 paragraph (2) letter (b) of the Code of Criminal Procedure were communicated, namely the obligation to report in writing, within 3 days, any change of address, and his attention was drawn to the tact that, in the event of failure to comply with this obligation, summonses and any other documents sent to the original address remain valid and are deemed to have been received by him. Il. Criminal Decision No. 297 of 22 April 2024, issued by the Alba Iulia Court of Appeal in Case No. 4573/221/2023: Criminal Decision No. 297 of 22 April 2024, was rendered in the same criminal proceeding (Case No. 4573/221/2023) during the appeal phase. During the appeal proceedings, the convicted person was served with a summons at the same address provided by the convicted person [de opgeëiste persoon] during the criminal investigation; this address was not changed during the proceedings, and the acknowledgment of receipt of the summons was signed by a certain [naam oma o.p. ] , as a person residing with the addressee. Consequently, all the clarifications previously provided regarding Criminal Judgment No. 86 of 15 January 2024, apply accordingly, as pertaining to; the convicted person's provision of an address; the obligation to report any change of address; the express notification of the consequences of failing to comply with this obligation; and the failure to provide a new address during the proceedings. III. Criminal Judgment No. 1409 of 10 October 2025, handed down by he Deva City Court in Case No. 6718/221/2024: 1. Regarding the Notification of the Convicted Person of the Date and Location of Court Hearings The convicted person was not personally summoned. The summonses were sent to the address he provided during the criminal investigation, namely in the town of Cãlan, [adres] , [plaats] . The acknowledgment of receipt of the summons for the court hearing in this case was signed by [naam oma o.p. ] as a person residing with the addressee. 2 Response to the questions raised in item 2, of the request a. Did the convicted person provide his address to the Romanian authorities, and were the summonses sent to that address? Yes. During the criminal investigation, the convicted person, [de opgeëiste persoon] , was questioned: • as a suspect, on 26 May 2023, 8 March 2024, and 3 June 2024; • as a defendant, on 8 March 2024, and 4 June 2024. At each of these hearings, the convicted person provided the same address or the service of procedural documents. A review of the case file reveals that he did not subsequently provide another address. Furthermore, in the notarized affidavit filed for the hearing scheduled for 13 November 2024, the convicted person confirmed the same residential address in the town of Cãlan, [adres] , [plaats] . b. Was the convicted person informed of the obligation to report a change of address and of the consequences of failing to comply with this obligation? Yes At each hearing during the criminal investigation, the convicted person was informed of the obligation to report any change of address in writing within 3 days, as well as of the fact that, in the absence of such notification, all summonses and any other documents sent to the original address remain valid and are deemed to have been received. These mentions are recorded in the minutes dated 26 May 2023, 8 March 2024, 3 June 2024, 8 March 2024, and 4 June 2024, signed by the convicted person. c. Did these instructions apply to the entire criminal proceeding, and was the convicted person expressly informed of this tact? The instructions provided to the convicted person regarding the obligation to report any change of address and the consequences of failing to comply with this obligation applied to the entire criminal proceeding, as evidenced by the minutes drawn up and signed during the hearings at which the provisions of Article 108 paragraph (2) letter (b) of the Code of Criminal Procedure were communicated, namely the obligation to report in writing, within 3 days, any change of address, and his attention was drawn to the fact that, in the event of failure to comply with this obligation, summonses and any other documents sent to the original address remain valid and are deemed to have been received by him. IV. Criminal Decision No. 823 of 15 December 2025, issued by the Alba Iulia Court of Appeal in Case No. 6718/221/2024: Criminal Decision No. 823 of 15 December 2025 was rendered in the same criminal proceeding, during the stage of resolving the appeal. At this stage, the convicted person was served with a summons at the same address provided during the criminal investigation, and the acknowledgment of receipt of the summons was signed by [naam oma o.p. ] , as a person residing with the addressee. The convicted person did not provide an alternative address for the service of procedural documents. Therefore, all the clarifications previously. provided regarding Criminal Judgment No. 1409 of 10 October 2025 a1so apply to Criminal Decision No. 823 of 15 December 2025 concerning the indication of the address, the obligation to notify any change thereof, express notification of the consequences of failing to comply with this obligation, and the validity of communications sent to the declared address. Standpunt van de verdediging De raadsvrouw heeft zich gerefereerd aan het oordeel van de rechtbank ten aanzien van de weigeringsgrond van artikel 12 OLW nu uit de aanvullende informatie blijkt dat de opgeëiste persoon een adresinstructie heeft gehad, dat hij een adres heeft opgegeven en dat hij is opgeroepen op het door hem opgegeven adres. Standpunt van de officier van justitie De officier van justitie heeft zich op het standpunt gesteld dat zowel in - het strafvonnis nr. 1409 van 10.10.2025, gewezen door de Rechtbank Deva in zaak nr. 6718/221/2024, onherroepelijk geworden op 15.12.2025 krachtens strafrechtelijk arrest nr. 823 van 15.12.2025 van het Hof van Beroep Alba Iulia als - Criminal Judgment no. 86 by the Court of Deva City, issued on 15 January 2024 in case no. 4573/221/2023 en Criminal Decision No. 297 of 22 April 2024, issued by the Alba lulia Court of Appeal in Case No. 4573/221/2023 de hoger beroepen aan artikel 12 OLW moeten worden getoetst. Primair heeft de officier van justitie zich op het standpunt gesteld dat de situatie als bedoeld in artikel 12, sub b, OLW zich voordoet. De opgeëiste persoon is vertegenwoordigd door een gemachtigd advocaat. De oproepen voor de zittingen die tot de veroordelingen hebben geleid zijn naar het door opgeëiste persoon opgegeven adres gestuurd. De Roemeense autoriteiten hebben daarmee voldoende inspanningen verricht om opgeëiste persoon van de data en tijdstippen van de zittingen op de hoogte te stellen. Subsidiair heeft de officier van justitie de rechtbank verzocht af te zien van toepassing van de weigeringsgrond als bedoeld in artikel 12 OLW. De opgeëiste persoon is in het vooronderzoek gehoord en hij heeft een adres opgegeven. Ook heeft hij een adresinstructie gehad, die gold voor de gehele procedure, inclusief hoger beroep. De oproepen voor de zittingen die tot de veroordelingen hebben geleid zijn naar het door opgeëiste persoon opgegeven adres gestuurd. Oordeel van de rechtbank Ten aanzien van Strafvonnis nr. 1409 van 10.10.2025, gewezen door de Rechtbank Deva in zaak nr. 6718/221/2024, onherroepelijk geworden op 15.12.2025 krachtens strafrechtelijk arrest nr. 823 van 15.12.2025 van het Hof van Beroep Alba Iulia. Als het proces in twee opeenvolgende instanties heeft plaatsgevonden, namelijk een procedure in eerste aanleg gevolgd door een procedure in hoger beroep, dan is de beslissing in de laatste van die procedures relevant voor de beoordeling of is voldaan aan de vereisten van artikel 4 bis, eerste lid, Kaderbesluit 2002/584/JBZ en artikel 12 OLW, voor zover daartegen geen gewoon rechtsmiddel meer openstaat en daarom de zaak ten gronde definitief is afgedaan. De rechtbank zal daarom de beslissing van het Hof van Beroep Alba Iulia van 15 december 2025 toetsen aan artikel 12 OLW. De rechtbank stelt op basis van de voornoemde aanvullende informatie van 23 juli 2026 vast dat de uitvaardigende justitiële autoriteit ten aanzien van de opgeëiste persoon een verzetgarantie heeft gegeven. De rechtbank is er ambtshalve mee bekend dat dergelijke garanties in Roemenië niet onvoorwaardelijk zijn. In het bijzonder is van belang dat een verzoek tot verzet alleen wordt toegewezen als de rechtbank in Roemenië van oordeel is dat de opgeëiste persoon bij verstek is veroordeeld (‘tried in absentia’). Uit het tweede lid van artikel 466 van het Roemeense Wetboek van Strafvordering (Roemeense Sv) volgt dat van een veroordeling bij verstek slechts sprake is als – kort gezegd – de verdachte niet is gedagvaard en niet op een formele wijze van de terechtzitting op de hoogte is gebracht. Gelet op het voorgaande doet zich de situatie als bedoeld in artikel 12, onder d, OLW niet voor. De rechtbank stelt vast dat de overlevering van de opgeëiste persoon is gevraagd voor de tenuitvoerlegging van een beslissing in hoger beroep. De opgeëiste persoon was niet aanwezig bij het proces dat tot die beslissing heeft geleid. Ook is niet gebleken dat de opgeëiste persoon – kort gezegd – in persoon is gedagvaard of op andere wijze daadwerkelijk officieel in kennis is gesteld van het proces, dat hij is vertegenwoordigd door een gemachtigd advocaat en dat hij in kennis is gesteld van de tijd en plaats van de zitting die tot de beslissing heeft geleid, of dat de beslissing in persoon aan hem is betekend en hij daartegen geen rechtsmiddel heeft ingesteld of daarvan uitdrukkelijk heeft afgezien. Ook heeft de uitvaardigende autoriteit niet onvoorwaardelijk gegarandeerd dat de opgeëiste persoon alsnog in verzet of in hoger beroep kan gaan. De rechtbank kan in dit geval de overlevering weigeren. De rechtbank ziet in dit geval aanleiding om af te zien van haar bevoegdheid om de overlevering te weigeren. Zij licht dat toe. Uit het EAB en de van de Roemeense autoriteit ontvangen aanvullende informatie van 23 juli 2026 en 29 juli 2026 volgt dat het hoger beroep is ingesteld door de opgeëiste persoon en zijn gemachtigde raadsman. De machtiging bevindt zich in het strafdossier. De gemachtigde raadsman heeft de opgeëiste persoon in hoger beroep vertegenwoordigd. Verder is gebleken dat de opgeëiste persoon in het voorbereidend onderzoek een adres heeft opgegeven, te weten het adres Cãlan, [adres] , [plaats] . Hij heeft gedurende de procedure geen ander adres opgegeven. Ook heeft hij een adresinstructie ontvangen, waarbij hij is gewezen op de verplichting om adreswijzigingen door te geven en op de gevolgen van het nalaten daarvan. Deze adresinstructie gold voor de gehele procedure, inclusief hoger beroep. Dat de opgeëiste persoon hiervan in kennis is gesteld blijkt uit de ondertekende verbalen van de verhoren. De oproep voor de zittingen die tot de beslissing heeft geleid is gezonden aan het door de opgeëiste persoon opgegeven adres. De oproep is in ontvangst genomen door [naam oma o.p. ] . Ter zitting heeft de opgeëiste persoon verklaard dat zij zijn oma is, dat hij bij haar heeft gewoond en dat hij haar adres aan de autoriteiten had opgegeven. De rechtbank stelt dan ook vast dat de opgeëiste persoon van de procedure tegen hem op de hoogte was en dat het toestaan van de overlevering geen schending van de verdedigingsrechten van de opgeëiste persoon oplevert. Voor zover de opgeëiste persoon al niet uit eigen beweging stilzwijgend afstand heeft gedaan van zijn recht om in persoon te verschijnen bij het proces dat tot dit vonnis heeft geleid, dan is hij op zijn minst kennelijk onzorgvuldig geweest met betrekking tot zijn bereikbaarheid voor officiële correspondentie. Ten aanzien van Criminal Judgment no. 86 by the Court of Deva City, issued on 15 January 2024 in case no. 4573/221/2023 en Criminal Decision No. 297 of 22 April 2024, issued by the Alba lulia Court of Appeal in Case No. 4573/221/2023 . Als het proces in twee opeenvolgende instanties heeft plaatsgevonden, namelijk een procedure in eerste aanleg gevolgd door een procedure in hoger beroep, dan is de beslissing in de laatste van die procedures relevant voor de beoordeling of is voldaan aan de vereisten van artikel 4 bis, eerste lid, Kaderbesluit 2002/584/JBZ en artikel 12 OLW, voor zover daartegen geen gewoon rechtsmiddel meer openstaat en daarom de zaak ten gronde definitief is afgedaan. De rechtbank zal daarom de beslissing van het Hof van Beroep Alba Iulia van 22 april 2024 toetsen aan artikel 12 OLW. De rechtbank stelt vast dat de overlevering van de opgeëiste persoon is gevraagd voor de tenuitvoerlegging van een beslissing in hoger beroep. De opgeëiste persoon was niet aanwezig bij het proces dat tot die beslissing heeft geleid. Ook is niet gebleken dat de opgeëiste persoon – kort gezegd – in persoon is gedagvaard of op andere wijze daadwerkelijk officieel in kennis is gesteld van het proces, dat hij is vertegenwoordigd door een gemachtigd advocaat en dat hij in kennis is gesteld van de tijd en plaats van de zitting die tot de beslissing heeft geleid, of dat de beslissing in persoon aan hem is betekend en hij daartegen geen rechtsmiddel heeft ingesteld of daarvan uitdrukkelijk heeft afgezien. Ook heeft de uitvaardigende autoriteit niet gegarandeerd dat de opgeëiste persoon alsnog in verzet of in hoger beroep kan gaan. De rechtbank kan in dit geval de overlevering weigeren. De rechtbank ziet in dit geval aanleiding om af te zien van haar bevoegdheid om de overlevering te weigeren. Zij licht dat toe. Uit het EAB en de van de Roemeense autoriteit ontvangen aanvullende informatie van 23 juli 2026 en 29 juli 2026 volgt dat de opgeëiste persoon in het voorbereidend onderzoek meerdere keren als verdachte is gehoord. Hij heeft bij iedere verhoor steeds hetzelfde adres opgegeven, te weten het adres Cãlan, [adres] , [plaats] . Hij heeft gedurende de procedure geen ander adres opgegeven. Bij deze verhoren heeft hij steeds een adresinstructie gekregen, waarbij hij is gewezen op de verplichting om adreswijzigingen door te geven en op de gevolgen van het nalaten daarvan. Hij heeft voor ontvangst hiervan getekend. De instructie gold voor de gehele procedure. Dat de opgeëiste persoon hiervan in kennis is gesteld blijkt uit de ondertekende verbalen van de verhoren die zijn ondertekend. De oproep voor de zittingen die tot de beslissing hebben geleid is gezonden aan het door de opgeëiste persoon opgegeven adres. De oproep is in ontvangst genomen door [naam oma o.p. ] . Ter zitting heeft de opgeëiste persoon verklaart dat zij zijn oma is, dat hij bij haar heeft gewoond en dat hij haar adres aan de autoriteiten had opgegeven. De rechtbank stelt dan ook vast dat de opgeëiste persoon van de procedure tegen hem op de hoogte was en dat het toestaan van de overlevering geen schending van de verdedigingsrechten van de opgeëiste persoon oplevert. Voor zover de opgeëiste persoon al niet uit eigen beweging stilzwijgend afstand heeft gedaan van zijn recht om in persoon te verschijnen bij het proces dat tot dit vonnis heeft geleid, dan is hij op zijn minst kennelijk onzorgvuldig geweest met betrekking tot zijn bereikbaarheid voor officiële correspondentie. 5 Strafbaarheid De uitvaardigende justitiële autoriteit heeft de strafbare feiten niet aangeduid als lijstfeiten. Overlevering kan in dat geval worden toegestaan, als – kort gezegd – voldaan is aan de vereisten dat voor de feiten een vrijheidsstraf van ten minste vier maanden is opgelegd aan de opgeëiste persoon en de feiten ook naar Nederlands recht strafbaar zijn. De rechtbank stelt vast dat hieraan is voldaan. De feiten leveren naar Nederlands recht op: overtreding van artikel 107, eerste lid van de Wegenverkeerswet 1994; overtreding van artikel 8 van de Wegenverkeerswet 1994. 6 Artikel 11 OLW: detentieomstandigheden Inleiding De rechtbank heeft eerder vastgesteld dat uit de algemene detentieomstandigheden in Roemenië een reëel gevaar van onmenselijke of vernederende behandeling in de zin van artikel 4 Handvest van de grondrechten van de EU (Handvest) voortvloeit voor personen die in een Roemeense penitentiaire instelling worden gedetineerd, met name vanwege de overbevolking in de penitentiaire instellingen. Op 15 juli 2026 heeft het Internationale Rechtshulp Centrum (IRC) de volgende vragen aan de uitvaardigende justitiële autoriteit gesteld. “1. In which detention facility will Mr. [de opgeëiste persoon] most probably be detained after his surrender to Romania? 2. How much “personal space” (excluding sanitary facilities) will Mr. [de opgeëiste persoon] have in his cell in that prison? 3. If the personal space will amount between 3 sq. meters and 4 sq. meters excluding sanitary facilities, I would like to request you to answer the following questions regarding that prison as well: a. How are the “other aspects of physical conditions of detention” as meant in ECHR 24 July 2012, no. 35972/05 (Iacov Stanciu/Romania, § 169) in that detention facility? As mentioned in the aforementioned case, I would like to receive actual information on the material detention conditions, such as sanitary facilities, heating system, access to food, water and health care. In this connection, the Court finds it important that the issuing judicial authority will also comment on the possibilities of “purposeful activities” and “outdoor exercise”, as meant in the Annex to the CPT report “Living space per prisoner in prison establishments CPT standards (15 December 2015, CPT/Inf (2015)44)”, in its answer to this question.” Bij brief van 23 juli 2026 is door de uitvaardigende justitiële autoriteit de volgende aanvullende informatie verstrekt: 1. (… )he will initially be placed in the Bucharest-Rahova Penitentiary in order to carry out the quarantine period, for a length of time of 21 days, in a room that will provide him with a minimum space of 3 square meters. (…) 2. The individual named [de opgeëiste persoon] will be provided with a minimum of 3 square meters of personal space for the entire duration of his sentence, except when assigned to the open regime, during which time he will be provided with 4 square meters, including the bed and related furniture, excluding the space allocated to the sanitary facilities, with the number of inmates determined based on the room's floor area. Each inmate will be provided with an individual bed equipped with the necessary bedding. (…) Regarding the time spent outside the detention room, we would like to inform you that every person deprived of liberty is guaranteed the right to a daily walk of at least one hour, with the amount of time spent outside the detention room being determined on an individual basis by the detention facility's administration, depending on the inmate's participation in work activities, educational, cultural, therapeutic, and sports activities, psychological counseling and social assistance, moral and religious activities, as well as academia instruction and vocational training. Furthermore, each inmate is provided with a range of other activities that take place outside the detention room, such as: the right to shop, access to sports activities within the facility, the ability to consult their legal status and other matters related to the enforcement of their custodial sentence through the electronic information and documentation center installed in the detention unit, and the ability to maintain contact with their support network through visits and online communications, thereby creating the opportunity to spend significantly more time outside the detention room. Daily activities will be organized by the detention facility's administration so that as much time as possible can be spent outside the detention room. (…) Inmates in guaranine and under observation at the Bucharest-Rahova Penitentiary are guaranteed the rights to a daily walk lasting 2 hours, while inmates assigned to a closed-regime facility who are serving their sentences at the Arad Penitentiary are guaranteed the right to a daily walk lasting 3 hours. Under the semi-open regime, rooms' doors remain open throughout the day. Inmates have access throughout the day, according to a schedule approved by the facility's administration, to the exercise yards, which are equipped with designated smoking areas. Under the open regime, rooms' doors are kept open at all times, except during Jhe periods required for meal service or administrative activities (organizing and conducting roll call, and other exceptional situations). Inmates have unlimited access to the exercise yards, which are equipped with designated smoking areas. (…)” Stanpunt van de raadsvrouw De raadsvrouw heeft zich primair op het standpunt gesteld dat geen gevolg dient te worden gegeven aan het EAB en dat de officier van justitie niet-ontvankelijk dient te worden verklaard. Uit de van de Roemeense autoriteit ontvangen aanvullende informatie blijkt dat de opgeëiste persoon in drie gevangenissen kan worden geplaatst. Voor elk van die gevangenissen moet dan ook worden getoetst aan artikel 11 OLW. Bucharest-Rahova: de opgeëiste persoon zal hier de eerste 21 dagen in quarantaine verblijven. De opgeëiste persoon stelt dat dit een vreselijke en een gevaarlijke gevangenis is. Reden waarom namens hem een beroep op artikel 11 OLW wordt gedaan. Deze gevangenis was onderwerp in een televisie documentairereeks over de zwaarste gevangenissen ter wereld. Daarbij komt dat er in de verstrekte informatie over deze gevangenis de mogelijkheid tot wandelen wordt vermeld, maar niet dat dit in de buitenlucht zou zijn, terwijl dit volgens de European Prison Rules wel een vereiste is. Arad: De garantie van minimaal 3 m2 leefruimte wordt hier niet gegeven. Minder dan 3 m2 persoonlijke ruimte maakt dat sprake is van een sterk vermoeden van schending van het verbod op een onmenselijke of vernederende behandeling, ex artikel 3 EVRM. Temeer nu van compenserende factoren geen sprake is. Deva; Ook hier worden minimaal 3 m2 leefruimte en de mogelijkheid tot luchten niet genoemd. Pas in deze gevangenis is kennelijk sprake van de mogelijkheid tot bellen en het recht op bezoek. Dat vervolgens in zijn algemeenheid wordt opgemerkt dat de opgeëiste persoon overal minimaal 3 m2 leefruimte zal krijgen, lijkt niet geloofwaardig, gelet op de uitgebreide beschrijvingen over de gevangenissen daarvoor, waarin dit niet genoemd wordt. Mede gelet op de zorgen van de opgeëiste persoon over de detentieomstandigheden in Roemenië, wordt die algemene stelling dan ook onvoldoende geacht om het algemeen gevaar voor schending van de grondrechten, zoals gewaarborgd in het EU-Handvest, te weten de artikelen 1, 4, 6, 7 van het Handvest, weg te nemen. Subsidiair heeft de raadsvrouw de rechtbank verzocht de behandeling van de zaak aan te houden om nadere vragen over de detentieomstandigheden te kunnen stellen. Standpunt van de officier van justitie De officier van justitie heeft zich op het standpunt gesteld dat de overlevering kan worden toegestaan. Met de door de Roemeense autoriteit verstrekte garanties is het vastgestelde algemene gevaar voor de opgeëiste persoon weggenomen. Bij uitspraak van 15 juli 2026 heeft de rechtbank de overlevering naar Bucharest-Rahova toegestaan en bij uitspraak van 2 november 2023 de overlevering naar Deva . Oordeel van de rechtbank Aan de hand van een globale beoordeling van alle gegevens waarover zij beschikt, gaat de rechtbank uit van de geboden zekerheid in de garantie zoals neergelegd in de aanvullende informatie van 23 juli 2026. De rechtbank is, gelet op deze garantie van de Roemeense autoriteiten, van oordeel dat het vastgestelde algemene reële gevaar van onmenselijke of vernederende detentie-omstandigheden voor de opgeëiste persoon is weggenomen. Het algemene gevaar, dat de rechtbank ten aanzien van de detentieomstandigheden in Roemeense penitentiaire inrichtingen heeft aangenomen, wordt door de garantie immers uitgesloten ten aanzien van de opgeëiste persoon. Dit algemene gevaar ziet, gelet op de overbevolking, op de hoeveelheid vierkante meters persoonlijke ruimte exclusief sanitair waarover de opgeëiste persoon kan beschikken. Nu er ten minste 3 m2 persoonlijke ruimte is gegarandeerd en er verder geen slechte materiële detentieomstandigheden zijn, is het algemene gevaar weggenomen volgens het geldende criterium uit het arrest Generalstaatsanwaltschaft (Detentieomstandigheden in Hongarije) van het Hof van Justitie van de EU. Dit betekent dat de detentieomstandigheden niet aan de overlevering in de weg staan. De rechtbank ziet geen aanleiding de behandeling van de zaak aan te houden om de Roemeense autoriteit nadere vragen over de detentieomstandigheden te stellen en wijst het daartoe strekkende verzoek van de raadsvrouw af. 7 Slotsom De rechtbank stelt vast dat het EAB voldoet aan de eisen van artikel 2 OLW. Verder staan geen weigeringsgronden aan de overlevering in de weg en is geen sprake van een geval waarin aan het EAB geen gevolg mag worden gegeven.
