De EU Commissie had inloggen via Facebook toegestaan voor een conferentiewebsite, waarbij het IP-adres van verzoeker naar Facebook (VS) is verzonden. Op dat moment was er geen adequaatheidsbesluit of enige andere passende waarborg. Hierdoor voldeed de Commissie niet aan de voorwaarden voor internationale doorgifte die Verordening 2018/1725 stelt (punten 187-193). Het Gerecht komt ook tot een schadevergoeding van EUR 400 (punten 194-200).
