Aankoop. Schadeclaim tegen de overheidsinstantie. Het beroep op het beginsel van estoppel wordt gehonoreerd. De eiseres heeft de beslissing van de aanbesteding niet binnen 20 dagen aangevochten in een voorlopig geschil. Volgens de voorwaarden van de aanbesteding heeft ze daarmee ook haar recht op schadevergoeding laten vervallen. Het toepassen van deze "vervalbedinging" is hier niet onredelijk of onevenredig.
