“Als het zoals in deze zaak aan de orde is gaat om de vervaardiging van een afbeelding door gebruikmaking van de camerafunctie van een smartphone, brengt de aard van de smartphone als technisch hulpmiddel mee dat de kenbaarheid van de aanwezigheid van dit hulpmiddel mede moet worden beoordeeld aan de hand van de kenbaarheid van het (daadwerkelijke) gebruik van die camerafunctie.”
