Officieel moet de Raad nog komen met de eigen positie op de Digitale Omnibus, maar Euractiv heeft een gelekte versie gepubliceerd. De aanpassing van de definitie van persoonsgegevens zoals voorgesteld wordt in het gelekte voorstel niet overgenomen door de Raad. Ook wordt de definitie van wetenschappelijk onderzoek geschrapt, 96 uur blijft 72 uur bij datalekken, de uitgebreide rol die de Commissie zichzelf toedichtte in het voorstel bij allerlei richtsnoeren etc. wordt grotendeels niet overgenomen en de aanpassingen aan artikel 22 AVG worden ook niet overgenomen, om maar wat te noemen.
