Summary

Overlevering. Griekenland. Tussenuitspraak.

Het EAB vermeldt in onderdeel d): “The person was not personally served with the decision, but - the person will be personally served with this decision without delay after the surrender, and - when served with the decision, the person will be expressly informed of his or her right to a retrial or appeal, in which he or she has the right to participate and which allows the merits of the case, including fresh evidence, to be re-examined, and which may lead to the original decision being reversed, and - the person will be informed of the timeframe within which he or she has to request a retrial or appeal, which will be ten (10) days.” In which detention facility will [opgeëiste persoon] most likely be detained, in case the surrender to Greece will be authorized? 2. Can it be guaranteed that [opgeëiste persoon] will not be detained in the detention facility of Thessaloniki, Komotini or Trikala? Could you also provide the following information, with regard to the CPT-report published on 4 March 2026: 3. What is the current occupancy rate of the detention facility where [opgeëiste persoon] will be detained? Furthermore, what is the specific, current occupancy rate in the particular ward or prison-section in which [opgeëiste persoon] is most likely to be detained following his surrender to Greece? 4. How much personal space (excluding sanitary facilities) do detainees in this detention facility have at their disposal in single-occupancy cells and multi-occupancy cells, respectively, in the different wards of the facility? Are the sanitary facilities in the cells adequately separated or partitioned to ensure sufficient privacy? 5. If the available personal space amounts between 3 m² and 4 m² excluding sanitary facilities, I would like to request you to answer the following questions as well (in light of the Dorobantu-judgement, ECLI:EU:C:2019:857, paragraph 75): a. How many hours per day do detainees spend in their cells? b. What opportunities do detainees have for outdoor exercise, work, sports, education, and other activities outside their cells? c‚ Are these opportunities, as meant in question 3b, accessible to all detainees? d. How many hours per day can detainees participate in these activities, assuming they choose to take part in the available options? e. Does the detention facility generally have decent detention conditions and is the wanted person not subjected to other elements that are considered aggravating circumstances for poor detention conditions? 6. If the detainees in the detention facility where [opgeëiste persoon] will most likely be detained have less than 3 m²? of personal space excluding sanitary facilities, keeping in mind the judgement of the Court of Justice of the European Union ECLI:EU:C:2019:857 (Dorobantu, para. 73), please also answer the following questions: a. Are these reductions in the required minimum personal space of 3 m² short, occasional and minor? b. Are such reductions accompanied by sufficient freedom of movement outside the cell and adequate out-of-cell activities? c. Does the detention facility generally have decent detention conditions and is the wanted person not subjected to other elements that are considered aggravating circumstances for poor detention conditions? 7. Do all detainees at the detention facility where [opgeëiste persoon] will most likely be placed have access to their own bed, including a mattress and bedding? 8. Could you provide an overview of the current situation regarding the maintenance and hygiene of cells and communal areas at the Chios Penitentiary, and could you give an overview of the measures that have yet been taken and their effectiveness? 9. How many doctors and nurses are employed at the detention facility? 10. The court has taken note of the response provided by the Greek authorities to the report of 30 January 2026, following the findings set out in the CPT report of 4 March 2026 concerning conditions in Greek detention facilities, The court understands from this response that the Greek authorities have announced measures and has paid particular attention to the measures relating to: a. overcrowding; b. interpersonal violence among detainees; c. the culture of impunity; d. the significant influence of power groups; e. the lack of supervision and staffing; f. the shortage of medical personnel; g. the absence of complaint procedures for detainees. Could you provide clarification regarding these specific topics on the situation at the detention facility where [opgeëiste persoon] will most likely be detained, including which concrete improvements have already been implemented at this detention facility following the CPT report, and which measures are still planned?” Op 13 augustus 2026 heeft the Deputy Head of General Directorate for Prison and Crisis Management voor zover van belang de volgende informatie verstrekt: "Further to the above-referenced communication, and for the information of the Danish [de rechtbank begrijpt: Nederlandse] judicial authorities regarding [opgeëiste persoon], we confirm the following: In Patras Correctional Facility, where the requested person will be detained pursuant to document No. 2107/F.EKD.3/2026 of the Kalamata Court of Appeals Prosecutor's Office, the requirement of 3 sq.m. of living space can be met, which includes the inmate's personal equipment (e.g., nightstand), but excludes the toilet, which is communal. The requested person/inmate will have a living space to move around of between 3 sq.m. and 4 sq.m. throughout the entire duration of their detention. In the event that at least 3 sq.m. of living space cannot be provided to him at the aforementioned Correctional Facility, the Central Committee for Prisoner Transfers will ensure his transfer to another Detention Facility where this requirement is met. In particular, the procedure to be followed in case the requirement of 3 square meters of living space is not met in the Prison, where a detainee is being held in execution of a European Arrest Warrant, is as follows: the detainee or the Penitentiary Administration submits a request for transfer to another Prison. The Central Transfer Committee may consider this request as a priority, in accordance with the provision of Article 9 of the Penitentiary Code, as amended by Article 10 of Law 4985/2022, in order to transfer the prisoner as soon as possible to a Correctional Facility where the above requirement is met. Furthermore, detention in the country's Correctional Institutions is carried out in accordance with the provisions of the Correctional Code and the obligations of the Hellenic Republic arising from Article 3 of the European Convention on Human Rights. The competent correctional authorities shall take the measures provided for by the legislation in force to ensure detention conditions compatible with the aforementioned obligations, including conditions of hygiene, cleanliness, ventilation, security, and protection of detainees. If required, the procedures provided for by the legislation in force are implemented, including the transfer procedure, so as to ensure the continuation of detention under conditions compatible with Article 3 of the European Convention on Human Rights. (...)" (…) Op 31 augustus 2026 heeft het IRC de volgende aanvullende vragen gesteld: “Thank you for your letters of 7 and 18 August and the information you have provided so far. A number of questions remain unanswered. In a different Greek surrender case (in which a similar situation occurred), the court of Amsterdam issued an interlocutory judgment. Therefore, I would like to ask you kindly if you could provide an answer to the following questions: 1. Do all detainees at the detention facility where [opgeëiste persoon] will most likely be placed have access to their own bed, including a mattress and bedding? 2. Could you provide an overview of the current situation regarding the maintenance and hygiene of cells and communal areas at the Patras Correctional Facility, and could you give an overview of the measures that have yet been taken and their effectiveness? 3. The court has taken note of the response provided by the Greek authorities to the report of 30 January 2026, following the findings set out in the CPT report of 4 March 2026 concerning conditions in Greek detention facilities. The court understands from this response that the Greek authorities have announced measures and has paid particular attention to the measures relating to: a. overcrowding; b. interpersonal violence among detainees; c. the culture of impunity; d. the significant influence of power groups; e. the lack of supervision and staffing; f. the shortage of medical personnel; g. the absence of complaint procedures for detainees. Could you provide clarification regarding these specific topics on the situation at the detention facility where [opgeëiste persoon] will most likely be detained, including which concrete improvements have already been implemented at this detention facility following the CPT report, and which measures are still planned?” The Patras Correctional Facility has a capacity of four hundred forty-six (446) inmates. Its strength today amounts to six hundred ninety-three (693) inmates. Efforts are made so that inmates have their own bed with a mattress, and if they wish, bedding from the facility is provided to them upon their entry. The placement of inmates in wards is based on nationality and common customs and traditions. 2. Maintenance of the inmates' wards is carried out by the Facility's maintenance team. Furthermore, the facility regularly performs disinfection and rodent control applications. For their personal hygiene, inmates receive shampoo, shower gel, washing powder, razors and shaving cream, a toothbrush, toothpaste, and toilet paper from the Social Service, upon their request. Most of them choose to procure personal hygiene items from the Facility's canteen products. The cleanliness of the wards and common areas is carried out under their personal responsibility and by working cleaners, respectively. 3. Regarding question 3a, we are not competent to answer. 4. Regarding questions 3b and 3d, we inform you that a Correctional Facility is a microcosm of society, with the difference being that it accommodates individuals with delinquent behavior as a whole, and during the day, their movement is free in all areas of the wing they belong to. 5. Regarding question 3c, we do not know what the term "culture of impunity" means. Inmates who commit disciplinary offenses under Article 68 of Law 2776/1999 "Correctional Code" are brought before the Disciplinary Board of the Facility and, if found guilty, are punished with the disciplinary penalties of Article 69 of Law 2776/1999 "Correctional Code", as amended by Article 59 of Law 4985/2022 "Re- adaptation and Modernization of the Correctional Code". 6. Regarding question 3e, the Facility features a closed-circuit television (CCTV) system with cameras in all internal and external common areas. 7. Regarding question 3f concerning medical staff, we have informed you via document No. 15436/18-08-2026 par. 9. 8. Regarding question 3g concerning complaint procedures, we have informed you via document No. 15436/18-08-2026 par. 10. Every inmate complaint is forwarded by our service to the competent departments of the Central Service of the respective Ministry and to the Supervising Prosecutor of the Correctional Facility." Op 9 september 2026 heeft the Deputy Head of General Directorate for Prison and Crisis Management de volgende informatie verstrekt: "(…) In Patras, where the requested person will be detained in accordance with document No. 22232/F.EKD.3/2026 of the Kalamata Appeals Prosecutor's Office, throughout the entire duration of his detention, the conditions of detention will be governed by the provisions of the Correctional Code and will comply with the international obligations of the Hellenic Republic, including Article 3 of the European Convention on Human Rights. Furthermore, by virtue of the provisions of Article 6A of the Correctional Code "Appeal of detainees regarding detention conditions and just satisfaction", the requested person has an effective domestic remedy at his disposal. He has the right to appeal before the Sentence Execution Court in order to report any inappropriate detention conditions, requesting either his immediate transfer or the implementation of other corrective measures, as well as the judicial pursuit of just monetary satisfaction. The Sentence Execution Court shall rule within thirty days of the filing of the appeal, and its decision is immediately executed by the Correctional Administration. In addition, it should be noted that to address the issue of overcrowding in Greek Correctional Institutions, the General Secretariat for Anti-Crime Policy is implementing a comprehensive action plan of short-term and long-term interventions for the 2025-2030 period, aiming at its permanent elimination. Within this framework, the new 2025-2030 construction program provides for the construction of eight new Correctional Institutions and the utilization of space in two existing Correctional Institutions, aiming at the creation of 6,800 new detention places, the gradual completion of which is expected to achieve the substantial decongestion of the Correctional Institutions. At the same time, the General Secretariat for Anti-Crime Policy promotes the development of alternative ways of serving sentences, through the institution of electronic monitoring, community service, and the strengthening of the institution of Agricultural Detention Facilities." (…) Patras Prison, built in 1978 and located in the industrial zone of the city, has a capacity of 446 beds and was holding 540 prisoners (121.1%) at the time of the visit. The prison consists of three accommodation blocks of three floors each, with prisoners held mostly in dormitories. Each accommodation block had its own large concrete outdoor exercise yard.(…) 45. (…) The delegation observed once again at both Korydallos I and Patras Prisons that the prisons only “functioned” because the officers were assisted by certain prisoners who were essentially carrying out prison officer duties, such as receiving all requests for exiting a wing and recording which prisoners left and entered the wing. (…) 59. At Patras Prison, in wings A, B and C, the accommodation mainly consisted of dormitories of approximately 23 m2 in which up to ten prisoners were placed, and of cells with two connecting rooms of approximately 15 m2 each, furnished with two sets of bunk beds. In addition to the bunk beds, all rooms were equipped with a table and a few chairs. Only some of the prisoners had nightstands with lockers. Access to natural light and artificial lighting was generally good and there was adequate ventilation. However, the material conditions were very poor. In all wings, there were broken windows, and prisoners told the delegation that when it rained water ran into the cells. Some fans and lightbulbs were not functioning, and the walls were dilapidated. The bathrooms in the cells were small and damp and the communal showers were dirty and mouldy, with many not working. For example, on the ground floor of C Wing, only five of the 12 showers were functional. (…) 63. Given the appallingly decrepit state of the kitchen at Patras Prison, where the equipment was black, dirty and rusty, and the whole area in an extremely unhygienic state, it is fortunate that there were no serious instances of food poisoning. The long overdue renovation of the kitchen was scheduled to start in February 2025. (…) 66. Prisoners in Chalkida, Malandrino, and Patras Prisons complained to the delegation that the call bells in the units did not work and in emergencies they had to shout down the corridors or out of the windows to alert prison staff. They reported that this creates serious delays when responding to emergencies. For instance, in Patras Prison, the delegation was told that when, in 2024, one person attempted to commit suicide in B Wing, it took the custodial officers 20 minutes to arrive and 20 more minutes to bring a stretcher. (…) 77. Several persons with physical disabilities met by the delegation at Nafplio and Patras Prisons were fully dependent on other prisoners, including for their personal hygiene and care or their mobility support, as some could not even access the toilet without assistance. In certain circumstances, such a situation may amount to inhuman and degrading treatment, in line with the case law of the European Court of Human Rights. (…) 89. Custodial officers are not present on the accommodation wings but remain in booths outside, merely controlling entry and exit to the wings, although in prisons such as Korydallos I and Patras, the one or two officers struggle even to keep a clear record of prisoners exiting the wings. (…) 91. At Patras Prison, the situation was also precarious, with 13 officers on the morning shifts and 10 in the afternoons to manage 540 prisoners. (…)” Patras Prison, built in 1978 and located in the industrial zone of the city, has a capacity of 446 beds and was holding 540 prisoners (121.1%) at the time of the visit. The prison consists of three accommodation blocks of three floors each, with prisoners held mostly in dormitories. Each accommodation block had its own large concrete outdoor exercise yard.” Het EHRM overwoog hiertoe het volgende: “In the present case, the applicants were detained in dormitories in wings A, B and C. Relying on a certificate by the Patras Prison administration prepared for the proceedings before the Court, the Government stressed that those dormitories measured 28.6 sq. m. They did not submit any primary evidence in support, such as floor plans, building documentation, etc. Accordingly, the Government failed to discharge the burden of proof, and the Court accepts the applicants’ argument that the dormitories had a surface area of 22.5 sq. m, which is also corroborated by a report of the European Committee for the Prevention of Torture following its visit in 2009.” At Patras Prison, in wings A, B and C, the accommodation mainly consisted of dormitories of approximately 23 m² in which up to ten prisoners were placed, and of cells with two connecting rooms of approximately 15 m² each, furnished with two sets of bunk beds.” Zie artikel 23 Overleveringswet. Zie artikel 22, eerste en derde lid, OLW.
