Het Gerecht werd gevraagd te oordelen of de EDPB bindende besluiten inzake Meta wel gehandhaafd konden blijven. Het ging om Bindende Besluiten nummers 3/2022, 4/2022 en 5/2022 waarin de EDPB de Ierse toezichthouder (DPC) corrigeerde en zelfs stelde dat de DPC in voorkomend geval nader onderzoek moest doen.
