Necessity/proportionality: An employer may consider whether the use of internal email by staff (i) was necessary for the performance of their contract of employment; (ii) whether the content may become relevant for a report on their conduct in the service; (iii) whether a shortened version would suffice for proper management of personal files; and (iv) the fact that the staff in question contravened rules on the use of the internal email system by using it, as members of a trade union, for purposes of that union, and not for gainful purposes. Zum Einwand der Kläger, dass die Dokumentation ihrer Gewerkschaftszugehörigkeit für die Erfüllung ihrer Verträge mit der EZB nicht relevant gewesen sei, genügt der Hinweis, dass die EZB in Anbetracht des Verbotes der Führung von Nebenakten zu Recht angenommen hat, die Aufnahme der streitigen Schreiben in die Personalakten der Kläger sei für die Erfüllung ihrer Dienstverträge "erforderlich" im Sinne von Artikel 5 Buchstabe c der Verordnung. Soweit diese Schreiben nämlich eine Abmahnung der Kläger enthalten, betreffen sie deren Dienstverhältnis und können für einen eventuellen Bericht über ihr dienstliches Verhalten im Sinne des Artikels 1.3.3 der Dienstvorschriften von Bedeutung sein.
