According to the Parliament, that finding of the General Court creates a new right of access to the material held by the Parliament, beyond the right of access to the file provided for in Article 41(2)(b) of the Charter. In that regard, the General Court did not set out the reasons that would justify the recognition of such a right, such recognition having no basis in Article 41(2)(a) of the Charter. Moreover, such recognition would have the effect of contradicting the general scheme of Article 41(2) of the Charter, point (b) of which establishes a clearly defined and complete means, allowing the data subject to have access to any material in the file concerning him or her.
