(¶¶ 99-100) ## Excerpt 99 En l’espèce, il est constant que les demandes d’accès présentées par le requérant sont clairement et uniquement fondées sur le règlement n° 1049/2001, la question soulevée par le présent litige concernant la validité de la réponse négative fournie par la Commission sur la même base juridique et, plus précisément, sur le fondement de l’article 4, paragraphe 1, sous b), dudit règlement, lequel prévoit une exception à l’accès à un document dans le cas où la divulgation porterait atteinte à la protection de la vie privée ou de l’intégrité de l’individu, notamment en conformité avec la législation de l’Union relative à la protection des données à caractère personnel.

100 En invitant le requérant à présenter une nouvelle demande d’accès au titre du règlement n° 45/2001 auprès d’un autre organe de l’institution, la Commission a non seulement méconnu le libellé de l’article 4, paragraphe 1, sous b), du règlement n° 1049/2001, qui établit un lien explicite entre les règlements nos 1049/2001 et 45/2001, mais a également adopté une position contraire aux exigences d’une bonne administration.
