Article 9

This new topic is needed because 'crisis response mechanism' is a specific procedural framework under the DSA/AI Act that enables rapid coordinated responses to emerging systemic risks, and it is not adequately covered by existing topics focused on individual authority powers or general safeguard procedures.
Article 73 of the Digital Services Act (DSA) establishes the primary legal framework for the crisis response mechanism for AI systems. This article empowers the European Commission to adopt implementing acts activating a specific crisis protocol for Very Large Online Platforms (VLOPs) and Very Large Online Search Engines (VLOSEs). The trigger is a extraordinary circumstance at Union level, such as a public security or public health threat, where the dissemination of illegal content or disinformation poses a serious risk. Recital 92 DSA underscores the role of independent audits in this context to verify compliance with these crisis protocols.
The mechanism is a coordinated, time-limited procedural framework. When activated by a Commission implementing act, designated providers must apply the specific measures outlined in the crisis protocol. These are expected to be proportionate and targeted actions, such as enhanced content moderation or specific transparency measures, to mitigate the identified systemic risk. The process is designed for rapid deployment, moving beyond general DSA obligations. The commentary emphasizes that compliance with activated crisis protocols is subject to verification through independent audits, as referenced in Recital 92. This creates a concrete compliance checkpoint: providers must not only execute the protocol but also be prepared to demonstrate their adherence to auditors.
