Overeenkomstig artikel 261 VWEU heeft het Europees Hof van Justitie volledige rechtsmacht ter zake van beroep tegen besluiten van de Commissie waarbij geldboeten of dwangsommen zijn opgelegd. Het kan de opgelegde geldboete of dwangsom intrekken, verlagen of verhogen.
