States attempted to censor the online activities of children. Courts and the Electronic Frontier Foundation (EFF) largely managed to prevent this: a look back at 2025.

In at least a dozen states, lawmakers believe they can pass laws that prohibit young people from accessing social media, or that require them to obtain parental consent before logging in. Fortunately, almost all courts that have reviewed these laws have ruled that they violate the constitution. It's not just the courts telling these lawmakers they are wrong. The Electronic Frontier Foundation (EFF) has filed briefs with courts across the country over the past year, explaining how these laws violate the freedom of speech of young people, as protected by the First Amendment.

Brussels, November 28th - The European Data Protection Board (EDPB) has published a call for expressions of interest for the creation of a new reserve pool for the "Support Pool of Experts" (SPE) program. Since September 2025, the General Data Protection Regulation (GDPR) has been in effect. This new European regulation aims to give consumers within the EU more control over the use of their data. In the Netherlands, enforcement of the GDPR has also begun, as the Implementation Act for the GDPR came into force on November 21st. In the Netherlands, the Authority for Consumers and Markets (ACM) and the Data Protection Authority (AP) are responsible for monitoring compliance.

ICO Publishes Draft Employee Monitoring Guidance for Consultation

Danish SA Declares Use of Google Analytics Unlawful Without Supplementary Measures

The Danish Data Protection Agency has looked into the tool Google Analytics and its settings, and the terms under which the tool is provided. On the basis of this review, the Danish Data Protection Agency concludes that the tool cannot, without more, be used lawfully. Lawful use requires the implementation of supplementary measures in addition to the settings provided by Google.

Irish Data Protection Commissioner Fines Instagram EUR 405M for Children Privacy Violations
